Enyula Concepts (Pty) Ltd [“the owner”] hires to the customer the equipment described overleaf (“the equipment”) in terms of these General Conditions of Hire.
The parties elect their respective domicile for the purposes of notice and service of process and proceeding at the addresses stated overleaf.

1. Deposit

A payment of 25% non-refundable deposit of the total contract value is needed to effect a valid booking. Thereafter 50% is payable 30 days before hiring date or event date and 100% is payable 7 days before date of the event.

2. Cancelation/Changes

If you want to cancel a confirmed booking, you must do so in writing and the following provisions shall apply.

2.1 75% is refundable for cancellations/changes made more than 21 days before event/date of hiring.

2.2 50% is refundable for cancellations/changes made less than 21 days before event/date of hiring.

2.3 30% is refundable for cancellation/changes made less than 14 days before event/date of hiring.

2.4 10% is refundable for cancellation/changes made less than 7 days before event/date of hiring.

2.5 Only delivery/setup fee will be refunded for cancellations less than 2 days before events/date of hiring.

3. Force Majeure

In the event of changes due to forces of nature or prevailing legislation, event will be postponed to a new date which is agreed to by both parties within 12 months.

4. Damages or Loss

4.1 In the event that any of the equipment is lost, destroyed, or damaged as a result of any cause whatsoever prior to the return thereof, the customer shall be liable to make the full replacement costs thereof.

4.2 Notwithstanding 4.2, unless the equipment is checked and accounted on return or collection in the presence of a representative of the owner, who accepts the correctness of a statement as to the quantity and condition of the equipment, the owner's statement regarding the quantity and condition of the equipment collected shall be final and binding on the customer.

5. Maintenance and return of equipment

The customer shall:

5.1 At all times during the event/hire period, provide dry, under cover storage & security until such time as the equipment is returned to the owner.

5.2 Immediately notify the owner should any of the equipment malfunctions. The owner shall repair or replace the equipment at its costs at the owner’s principal place of business, unless the owner in its sole discretion determines that the malfunction is due to improper use of the equipment.

5.3 Return the equipment in a clean state and in good order and repair, in particular, but without limitation.

5.4 All equipment, (except for tablecloths, furniture and marquees) must be washed and dried. Any equipment returned unwashed will be charged for a rate determined by the owner.

6. Use of equipment

The customer:

6.1 Acknowledges that it is aware of the purpose for which the equipment is intended and shall only use the equipment for such purpose.

6.2 Shall use the equipment at his own risk, and indemnifies the owner against any claim of any nature brought against it by the customer’ s employees, agents, representative, guests or any other third parties arising out of the use of the equipment by the customer or while in the possession of the customer or any other cause including a claim for consequential damages and loss of profit, and all costs and expenses incurred by the owner on an attorney and own client scale in defending or setting such proceedings.

6.3 Shall have no claim of any nature against the owner for any loss suffered or damages sustained by the
customer arising from any cause, including without limitation, the installation, use or malfunction of the equipment or the provisions of these General Conditions, other that the specific remedies provided for.

7. No Warranties

The owner furnishes no warranties and makes no representations other than those contained herein. The provisions

of these General Conditions shall govern the relationship of the parties to the exclusion of all other conditions, whether implied by law or stipulated by the customer, unless accepted by the owner in writing.

8. Access

The owner shall at all reasonable times be entitled to access any premises of the customer for the purposes of inspecting or repairing the equipment.

9. Amendments

9.1 Both parties agree that any changes to the agreed-upon event plan must be communicated in writing and agreed upon no later than 3 weeks prior to the scheduled event date or hire.

9.2 Any modifications requested after this stipulated time will be at the sole discretion of owner and may incur additional fees.

9.3 The parties acknowledge that last-minute changes may not be feasible due to logistical constraints and vendor commitments. In the event that changes are requested after the aforementioned deadline, the owner shall not be held liable for any resulting consequences or dissatisfaction.

10. Miscellaneous

10.1 Flower costs and availability is seasonal therefore, the owner will attempt to source similar type and value of flowers used on the quote.

10.2 The Owner reserves the right to use alternative products due to weather changes, availability or any other natural causes.

10.3 Clients are entitled to one mockup after payment of the deposit and are subject to a fee for flowers & setup.

10.4 Booking are valid for a single day’s use unless a prior arrangement is agreed to by both parties. Failure to comply with this will result in additional daily charges being levied.

10.5 Payment of a deposit to accept this invoice will be deemed as acceptance of the above-mentioned terms and conditions.

10.6 Transportation, meals and accommodation costs associated with the execution of the event (before, during and on the event day) will be borne by the Client.

10.7 The client acknowledges and agrees that the owner retains the right to photograph and document the event the decor and overall arrangements for promotional and marketing purposes. The owner reserves the right to use these images for marketing materials, portfolios and on their official social media platforms.

10.8 The owner will be accessible for the duration of the event, at an additional cost, should the client uptake coordination services.
